(a) Unless expressly allowed by a permit issued by the City or resulting from City employees, agents, or contractors performing Municipal duties, no person shall make, continue, allow, or cause to be made, continued, or allowed any loud, unnecessary, or unusual noise that annoys, disturbs, injures, or endangers the comfort, repose, health, peace, or safety of others within the City, whether such noise is of a human, animal, or mechanical nature.
(b) Noises prohibited by the foregoing subsection (a) include, without limitation, any noise with a sound pressure level in excess of (65) decibels - A-weighted (dB(A)) that occurs:
(1) Between the hours of 7:00 am and 10:00 pm, either:
A. Continuously for a duration of at least (30) minutes; or
B. Intermittently, occurring at least (3) times, in any (30)-minute period; or
(2) Between the hours of 10:00 pm and 7:00 am, either:
A. Continuously for a duration of at least (10) minutes; or
B. Intermittently, occurring at least (3) times, in any (30)-minute period.
(c) Sound pressure level is to be measured from the property line of private property from which the noise originates, whether such property is used for personal, commercial, institutional, or any other purpose, and measured 50 (fifty) feet from the source of the noise on public property.
