361.99 PENALTIES AND APPEALS.
   (a)   General Article Penalty. Whoever violates any provision of this article shall be assessed fines and penalties. according to the following:
      (1)   The following violations will result in a fine of ten dollars ($10.00) if paid within five (5) days; if paid after five (5) days but before thirty (30) days an additional twenty dollars ($20.00) penalty will apply for a total fine amount of thirty dollars ($30.00); if paid after thirty (30) days an additional thirty dollars ($30.00) penalty will apply for a total fine and penalty amount of sixty dollars ($60.00):
         A.   Expired meter;
          B.   Failure to display a valid parking permit or pay via an applicable mobile pay app at the Liberty Street Parking Lot;
         C.   Parking permit violation;
         D.   Exceeding the two (2) hour free parking;
         E.   Improper manner of parking;
         F.   Exceeding time in a ten minute take away parking space.
      (2)   Accessible parking violations (WV Code 17C-13-6): first conviction is two hundred dollars ($200.00); second conviction is three hundred dollars ($300.00); and subsequent convictions are five hundred dollars ($500.00).
      (3)   Violation of Section 361.04(a) is sixty dollars ($60.00).
      (4)   Abandoned or junked motor vehicles: not more than five hundred dollars ($500.00) or imprisonment of not more than thirty (30) days, or both.
      (5)   Other violations not otherwise listed in this section will result in a fine of sixty dollars ($60.00).
   
   (b)   To appeal a ticket, a person must notify the Charles Town Municipal Court within five (5) calendar days of the date and time the parking ticket was originally issued. At the time an appeal is made, the required fines and/or penalties will be fixed until a resolution is reached by a municipal judge. If the ticket is upheld as valid, the owner/operator will satisfy the fixed cost of the citation and may be subject to additional court costs.
