(a) Each day that a violation of this section continues will be considered a separate and distinct offense.
(1) No person will be found in violation of Section 549.02(b)(2) unless the City proves by a preponderance of the evidence that the abatement measures were reasonable and warranted and that the defendant knowingly failed to implement them.
(2) A fine in accordance with Section 549.04(b) may be assessed by the City of Charles Town Municipal Court.
(b) Upon a finding of liability under this article, the defendant may be fined not less than one hundred dollars ($100.00) and not more than one thousand dollars ($1,000.00) per offense.
