(a) “Controlled substance” means a drug, substance or immediate precursor in Schedules I through V of Article Two of Chapter GOA of the WV Code.
(b) “Drug” means:
(1) Substance recognized as drugs in the official “United States Pharmacopoeia, official Homeopathic Pharmacopoeia of the United States or official National formulary”, or any supplements to any of them;
(2) Substances intended for use in the diagnosis, cure, mitigation, treatment or prevision of disease in man or animals;
(3) Substances (other than food)) intended to affect the structure or any function of the body of man or animals; and
(4) Substances intended for use as a component of any article specified in subdivision (b)(1), (2) or (3) of this subdivision.
It does not include devices or their components, parts or accessories.
(c) “Gang” means any combination, confederation, alliance, network, conspiracy, understanding, or other similar conjoining, in law or in fact, of three (3) or more persons with an established hierarchy that, through its members or through the agency of any member engages in a course or pattern of criminal activity.
(d) “Illegal gambling” means accepting, recording or registering bets, or carrying on a policy game or any other lottery, or playing any games of chance, for money or something of value.
(e) “Incident” means the occurrence of an action or situation that is a separate unit of experience and which may include multiple criminal offenses that result in the arrest of the individual(s) present at the property.
(f) “Prostitution” means a sexual act or contact with another person in return for giving or receiving fee or a thing of value. (Ord. 2019-003. Passed 11-4-19.)
