141.10 PROCEDURES FOR ESTABLISHING A HISTORIC OVERLAY DISTRICT.
   (a)    The Charles Town Historic Landmarks Commission may request the City Council to include in a Historic Overlay District, those historic districts, in part or in whole that are listed on the West Virginia Landmark Register or the National Register of Historic Places, or
   (b)    The owner of any landmark, building or structure in the City of Charles Town, including those listed on the West Virginia Landmark Register or the National Register of Historic
Places, may make a written request of the Historic Landmarks Commission for the addition of such landmark, building, or structure to the Historic District. The Historic Landmarks Commission shall review the application within thirty (30) days of initial submission and make a recommendation to the City Council. A site description as described herein shall be provided for all such sites by the applicant:
      (1)   The location, size, and description of the site, including photographs of structures, and landscaping.
      (2)   A description of the known historic significance or importance of the site.
      (3)   Plans (if any) for the restoration or development for public use.
      (4)   Plan for utilities (sewer, water, heat) and parking systems for sites open to the public.
      (5)   Statements of the relationship of the site to existing land use in the surrounding area.
      (6)   Evidence that the applicant has sufficient control over the site to achieve the intent of this designation.
