This Article is enacted pursuant to W. V. Code Chapter 8, Article 12, Sections 16, 16a & 16c for the purpose of ensuring that each Vacant Property and each Vacant Structure in the City is properly monitored and maintained, does not pose a hazard to persons or property, is suitable for occupancy and use, and is safe for entry by police officers, fire fighters, and other emergency personnel in times of emergency. This article provides for registration and inspection of Vacant Properties and Vacant Structures, and corrective action to address deficient structures that pose a hazard to life, limb, health, property, safety, or welfare of the general public, and renovation, restoration and reuse of such vacant structures. However, because circumstances may not exist whereby a structure may temporarily be uninhabitable, not all non-code compliant structures will be declared "uninhabitable" under this Ordinance. A Vacant Properties Board is created under this Article as the enforcement agency under W. V. Code Section 8-12-16 (b) to supplement, but not supplant, the official duties of the Code Official under the State Building Code.
