The following additions, insertions and changes are hereby made to the State Building Code:
(a) Adopt the International Building Code, 2018 Edition and Appendixes. Modify the International Building Code, 2018 Edition, as adopted by State Code, as follows:
(1) Insert 'City of Charles Town' as appropriate and where prompted to do so by the International Building Code, 2018 Edition.
(2) Replace with the following: Section 1612.3. Insert 'July 1, 2013", where 'date to be inserted by the jurisdiction' appears.
(3) All appeals under the International Building Code, 2018 Edition and all appeals under this Article of the Charles Town Codified Ordinances, shall be made pursuant to Section 1705.05.
(4) All penalties for violation(s) of the International Building Code, 2018 Edition, shall be punishable under the specific provisions of Section 1705.06.
(b) Adopt the International Plumbing Code, 2018 Edition and Appendixes. Modify the International Plumbing Code, 2018 Edition, as adopted by State Code, as follows:
(1) Insert 'City of Charles Town' as appropriate and where prompted to do so by the International Plumbing Code, 2018 Edition.
(2) Insert the following: Section 106.6.2. Insert 'See Section 1705.03' where prompted to insert the jurisdiction's schedule.
(3) Insert the following: Section 106.6.3. Insert 'twenty-five (25%) percent' where the words 'specify percentage' appear in subparagraph 2 of 106.6.3, and 'fifty (50%) percent' where the words 'specify percentage' appear in subparagraph 3 of 106.6.3.
(4) Insert the following: Section 108.4. Insert 'misdemeanor' where the words 'specify offense' appear, delete the balance of paragraph, and replace with 'punishable under the specific penalties set forth in Section 1705.06 of this article.'
(5) Insert the following: Section 108.5. Insert 'one hundred dollars ($100)' where 'amount' first appears and 'five hundred dollars ($500.00)' where 'amount' next appears, and thereafter add the following language: 'as specifically set forth in Section 1705.06 of this article.'
(6) Insert the following: Section 305.4.1. Insert 'eighteen inches (18")' where the word 'number' first appears and insert 'two feet and six inches (2'6")' where the word 'number' next appears.
(c) Adopt the International Residential Code, 2018 Edition and Appendixes. Modify the International Residential Code, 2018 Edition, as adopted by State Code, as follows:
(1) Insert 'City of Charles Town' as appropriate and where prompted to do so by the International Residential Code, 2018 Edition.
(2) The following exceptions to the Code are as follows:
A. Chapter 11, entitled 'Energy Efficiency' is exempt from this rule.
B. Section G2415.12, Minimum Burial Depth, shall read as follows:
Underground piping systems shall be installed a minimum depth of 12 inches (305 mm) below grade. If the minimum depth cannot be maintained the piping systems shall be installed in conduit or shielded in an approved manner.
C. Section R311.7.5, Stair Treads and Risers, shall read as follows:
R311.7.5.1 Risers. The maximum riser shall be 8¼ inches.
R311.7.5.2 Tread Depth. The minimum tread depth shall be 9 inches.
D. Section R403.1.7.1, Building Clearances from Ascending Slopes, is not applicable to this rule.
E. Section R403.l.7.2, Footing Setbacks from Descending Slope Surfaces, is not applicable to this rule.
F. 87-4-5 of the State Rules, Fire Protection of Floors in Residential Buildings, shall read as follows:
5.1. New One and Two Family Dwellings over one level in height, New One and Two Family Dwellings containing a basement, and New One and Two Family Dwellings containing a crawl space containing a fuel burning appliance below the first floor, shall provide a method of fire protection of floors of a ½ inch (12.7 mm) gypsum wall board membrane, 5/8 inch (16 mm) wood structural panel membrane, or equivalent on the underside of the floor framing member. Alternatively, floor fire protection may be provided with wood floor assemblies using dimension lumber or structural composite lumber equal or greater than 2 inch by 10 inch (50.8 mm by 254 mm) nominal dimension, or other approved floor assemblies demonstrating equivalent fire performance. If the flooring does not meet the requirements of this section, the dwelling must contain an Automatic Fire Sprinkler System as set forth in Section 313.2 of the 2018 edition of the International Residential Code for One and Two Family Dwellings. Provided that: floor assemblies located directly over a space protected by an automatic sprinkler system as set forth in Section R 313.2 of the International Residential Code for One and Two Family Dwellings are exempt from this requirement.
G. All appeals under the International Residential Code, 2018 Edition, and all appeals under this Article of the Charles Town Codified Ordinances, shall be made pursuant to Section 1705.05.
H. All penalties for violation(s) of the International Residential Code, 2018 Edition, shall be punishable under the specific provisions of Section 1705.06.
(d) Adopt the International Mechanical Code, 2018 Edition and Appendixes. Modify the International Mechanical Code, 2018 Edition, as adopted by State Code, as follows:
(1) Insert 'City of Charles Town' as appropriate and where prompted to do so by the International Building Code, 2018 Edition.
(2) Insert the following: Section 106.5.2. Insert 'See Section 1705.03' where 'fee schedule' appears.
(3) Insert with the following: Section 106.5.3. Insert 'twenty-five (25%) percent' where the words 'specify percentage' appear in subparagraph 2 of 106.5.3 and 'fifty (50%) percent' where the words 'specify percentage' appear in subparagraph 3 of 106.5.3.
(4) Insert the following: Section 108.4. Insert 'misdemeanor' where 'specify offense' appears, 'five hundred dollars ($500.00)' where 'amount' appears and delete balance of paragraph and insert 'punishable under the specific penalties set forth in Section 1705.06 of this article.'
(5) Insert the following: Section 108.5. Insert 'one hundred dollars ($100.00)' where 'amount' appears for the first time in 108.5, and 'five hundred dollars ($500.00)' where 'amount' appears for the second time in 108.5, and after 'dollars' at the end of the paragraph, add: 'as specifically set forth in Section 1705.06 of this article.'
(6) With the exception of the fines enunciated in Sections 108.4 and 108.5, of the International Mechanical Code, 2018 Edition, all penalties for violation(s) of the International Mechanical Code, 2018 Edition, shall be punishable under the specific provisions of Section 1705.06 of the Charles Town Codified Ordinances.
(7) All appeals under the International Mechanical Code, 2018 Edition shall be made pursuant to Section 1705.05.
(e) Adopt the International Property Maintenance Code, 2018 Edition and Appendixes. Modify the International Property Maintenance Code, 2018 Edition, as adopted by State Code, as follows:
(1) Insert 'City of Charles Town' as appropriate and where prompted to do so by the International Property Maintenance Code, 2018 Edition.
(2) All appeals under the International Property Maintenance Code, 2018 Edition, shall be made pursuant to Section 1705.05, below.
(3) All penalties for violation(s) of the International Property Maintenance Code, 2018 Edition, shall be punishable under the specific provisions of Section 1705.06.
(f) Adopt the International Energy Conservation Code, 2015 Edition for Residential Buildings. Modify the International Energy Conservation Code, 2015 Edition, as adopted by State Code, as follows:
(1) Insert 'City of Charles Town' as appropriate and where prompted to do so by the International Energy Conservation Code, 2015 Edition.
(2) All appeals under the International Energy Conservation Code, 2015 Edition, shall be made pursuant to Section 1705.05, below.
(3) Section 108.4. Insert 'one hundred dollars ($100.00)' where 'amount' first appears in 108.4 and 'five hundred dollars ($500.00)' where 'amount' next appears in 108.4 and after 'dollars' add: 'as is specifically set forth in Section 1705.06 of this article.
(4) With the exception of the fine enunciated in Section 108.4, of the International Energy Conservation Code, 2015 Edition, all penalties for violation(s) of the International Energy Conservation Code, 2018 Edition, shall be punishable under the specific provisions of Section 1705.06 of the Charles Town Codified Ordinances.
(g) Adopt the International Existing Building Code, 2018 Edition and Appendixes. Modify the International Existing Building Code, 2018 Edition, as adopted by State Code, as follows:
(1) Insert 'City of Charles Town' as appropriate and where prompted to do so by the International Existing Building Code, 2018 Edition.
(2) Where reference is made to International Fire Code, replace with the applicable rule of the NFPA 101 Life Safety Code, 2021 Edition.
(4) All appeals under the International Existing Building Code, 2018 Edition, shall be made pursuant to Section 1705.05.
(5) All penalties for violation(s) of the International Existing Building Code, 2018 Edition, shall be punishable under the specific provisions of Section 1705.06.
(i) Adopt the International Fuel Gas Code, 2018 Edition and Appendixes. Modify the International Fuel Gas Code, 2018 Edition, as adopted by State Code, as follows:
(1) Insert 'City of Charles Town' as appropriate and where prompted to do so by the International Fuel Gas Code, 2018 Edition.
(2) Insert the following: Section 404.12. Following the end of the paragraph, insert the sentence: 'lf the minimum depth cannot be maintained, the piping systems shall be installed in conduit or shielded in an approved manner.'
(3) Add the following: Section 108.4. Insert 'misdemeanor' where the words 'specify offense' appear. Delete balance of paragraph and insert: 'punishable under the specific penalties set for the in Section 1705.06 of this article.'
(4) Insert the following: Section 108.5, insert 'one hundred dollars ($100.00)' where 'amount' first appears in 108.5 and 'five hundred dollars ($500.00)' where 'amount' next appears in 108.5.
