1103.05 INJURING TREES.
   No person shall cut, saw, tear or break down any ornamental or shade trees, along the sidewalk or in any other public place in the City, or injure the same in any manner.
1103.06 PROHIBITION AGAINST BURNING OF ANY WEEDS, GRASS CLIPPINGS, LEAVES, BRUSH OR OTHER MATERIAL.
   (a)   No person shall burn or cause to be burned any weeds, grass clippings, leaves, brush, or other materials within City limits of Charles Town.
   (b)   The following exception is allowed by Special Activity Permit Only:
      (1)   Any property owner wishing to kindle or maintain a campfire or bonfire for cooking, recreational, or ceremonial purposes must have the area inspected and approved by the Fire Department before the first activity takes place.
      (2)   The person(s) involved must obtain a special activity permit annually through the City of Charles Town in advance.
      (3)   The area surrounding the fire must be thoroughly clean of any debris that might cause or spread a fire or explosion; and it shall be set at least ten feet away from any structure.
      (4)   The fire shall not be left unattended at any time. It is the responsibility of the property owner(s) to find proper and acceptable ways of extinguishing the fire.
      (5)   The Chief of the Fire Department(s) may prohibit any or all bonfires and outdoor rubbish fire when atmospheric conditions or local circumstances make such fires hazardous. (Ord. 99-08. Passed 4-20-99.)
