Appointments to all positions in the classified service that are not filled by promotion, transfer, or reduction, as provided by provisions of this chapter, shall be made only from those persons whose names are certified in writing by the Commission to the City Manager in accordance with the provisions of this Chapter.
(a) Number of names to be certified; appointment from other appropriate lists.
(1) The City Manager shall notify the Commission of an entrance position in the classified service that is to be filled, and the Commission shall, except as provided for in subsection (h) hereof, certify to the City Manager the names and addresses of the ten applicants standing highest on the eligible list for the class to which said position is classified. The Commission may certify less than ten names if ten names are not available. When less than ten names are certified to the City Manager, appointment from that list shall not be mandatory.
(2) The Director of Public Safety shall have discretion to make the original appointment of any one of the candidates on the list of ten applicants certified to the City Manager.
(3) If more than one position is to be filled, the Director of Public Safety as the appointing authority shall appoint one of the candidates remaining on the list of ten who is willing to accept the position.
(4) In the event that the names on an entrance eligible list are exhausted, then the City Manager may make temporary appointments which will be automatically terminated when a new eligible entrance list is created, except as specified in subsection (h) hereof.
(b) Veteran's Preference. Any person who has completed service in the uniformed services, who has been honorably discharged from the uniformed services or transferred to the reserve with evidence of satisfactory service, and who is a resident of this state and any member of the national guard or a reserve component of the armed forces of the United States who has completed more than one hundred eighty days of active duty service pursuant to an executive order of the president of the United States or an act of the congress of the United States may file with the director a certificate of service or honorable discharge, and, upon this filing, the person whose name appears on an eligible list for a position shall be entitled to preference in original appointment to any such position in the classified service of the City of Chardon over all persons eligible for such appointment and standing on the list thereof whose rating is the same as that of such former member of the armed services. Such preference shall be pursuant to Section 141.07(e).
(c) One of the persons certified to be appointed. Upon receipt from the Commission of such list of eligibles for a position, the Director of Public Safety shall fill such position or positions by appointment from the persons certified to him. The City Manager shall forthwith report to the Commission the name or names of such appointees, the title of the position, the duties and responsibilities of same, the salary or compensation thereof, and such other information as the Commission may require in order to keep its roster.
(d) Probationary period; probationary removal or reduction. All original appointments to the classified service shall be for a probationary period of 12 months with previous OPOTC certification or 18 months without previous OPOTC certification. All promotional appointments shall be for a probationary period of six months. If the service of the probationary employee is unsatisfactory as determined by the City Manager, the probationary employee may be removed or reduced at any time during the probationary period by the City Manager.
(e) Permanent residence. All appointees to entry level positions in the Police Department appointed after February 1, 2002 shall secure permanent residence in Geauga County or a county contiguous to Geauga County no later than 18 calendar months after appointment and shall continue to reside within such area while employed by the City of Chardon in the classified service in the Police Department. Failure to establish permanent residence as specified herein shall be grounds for dismissal from the classified service.
(f) Restriction to age, physical or other requirement. Any restriction for appointment from an eligible list as to age, physical or other requirements shall be made prior to and stated in the bulletin announcing the examination, and no eligible list shall be so restricted unless it had been announced in the examination bulletin.
(g) Emergency original appointments. In case of an emergency, as determined by the City Manager, an original appointment may be made without regard to the provisions of this chapter, but in no case to continue longer than ninety (90) days, and in no case shall successive original appointments be made; provided, however, that interim or emergency original appointments, made necessary by reason of sickness, disability, or unavailability of a regular employee, may exceed ninety (90) days, but shall continue only during such period of sickness, disability or unavailability. The acceptance or refusal of an emergency original appointment by an eligible applicant shall not affect his or her standing on the register for permanent appointment. All such emergency original appointments shall be promptly reported to the Commission by the City Manager. (Ord. 2618. Passed 9-9-10.)
(h) Promotions. Vacancies in positions above the entrance level in the classified service shall be filled, insofar as practicable, by promotions. Unless otherwise specified herein, promotion of classified personnel other than emergency or temporary promotions shall be made in accordance with Section 141.06(e) and (f).
(1) The City Manager shall notify the Commission in writing of a particular promotional position in the classified service that is to be filled, and the Commission shall, except as provided in subsection (i) hereof, certify to the City Manager the names standing highest on the eligible list for the class to which said position is classified. The Director of Public Safety shall make an appointment within thirty days from the date of such certification.
(2) If there is no eligible list for such position, the Commission shall, within 120 days of written notification by the City Manager, hold a competitive written examination and within 150 days hold an oral or assessment center examination. After such examinations have been held and an eligible list established, the Commission shall certify to the City Manager the names of the five applicants standing highest on the eligible list for the class to which said position is classified. The Director of Public Safety shall appoint one of such persons within thirty days from the date of such certification.
(3) In the event that the names on a promotional eligible list are exhausted, the City Manager may make temporary promotions which are automatically terminated when a new eligible list is created, except as specified in subsection (i) hereof. (Ord. 2885. Passed 7-9-15.)
(i) Emergency and temporary promotion. Emergency or temporary promotion of a member of the classified Civil Service to a higher rank or position within the classified service may be made without examination by the City Manager for a period not to exceed 180 days, and in no case shall successive emergency temporary promotions be made. However, an emergency or temporary promotion as hereinbefore defined, made necessary by reason of sickness, disability or unavailability of a regular employee, may be extended by the Civil Service Commission in excess of 180 days but shall continue only during the period of sickness, disability or unavailability.
