§ 95.48 DAMAGE TO MAILBOX BY SNOW DISCHARGE.
   If any mailbox is damaged or knocked down by snow discharge from a Public Works vehicle as determined by the Utilities and Streets Superintendent or his or her representative, the following shall apply:
   (A)   If the original mailbox was installed and properly maintained in accordance with the requirements contained in §§ 95.45 and 95.46, and is deemed impractical to repair, it will be reimbursed by $50 by the village. Any difference in cost, value or aesthetics between the damaged mailbox and the $50 reimbursement will be uncollectible by the owner.
   (B)   If the original mailbox was not installed and properly maintained in accordance with the requirements contained in §§ 95.45 and 95.46, the damage will be considered an event that no experience, foresight or reasonable care by Public Works Department personnel might have guarded against; such damage shall be considered an inevitable occurrence and as such, reimbursement for such will be uncollectible.
