A. Alley Obstructions Prohibited: It shall be unlawful for any person to place, cause or allow any structure, debris, vehicles, machinery, junk, garbage containers, wood or wood piles, or any other structure or object within any platted alley within the City, or to otherwise obstruct or interfere with the free use by the public of any platted alley within the City.
B. Nuisance Declared; Abatement: Violations of this Section are declared to be a nuisance and the City Council or its agent, after five (5) days' written notice to remove any structure, object or other obstruction from any platted alley within the City, may prevent, remove and summarily abate the same without judicial process and without further notice at the expense of the party creating or allowing or maintaining the same, and levy a special assessment and collect the same as provided in Idaho Code 50-1008 on the land or premises adjacent to such alley of such party to defray the cost or to reimburse the City for the cost of abating the same; or the City may bring any appropriate civil action, including abatement, injunction and/or damages, in which event the City shall be entitled to all costs including attorney's fees in the prosecution of such action.
C. Violation and Penalty: Any person violating any provision of this Section shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be subject to the penalties therefor as provided for in Section 1-4-1 of this Code. (Ord. 401, 3-11-80)
