It is hereby declared to be the intent of the governing body of the City to aid and assist by whatever means possible for the utmost consistency in traffic regulation among and between agencies of Idaho having such jurisdiction. Toward that end, adoption of the Idaho Motor Vehicle Laws by the cities of Idaho is a necessary means of assuring maximum uniformity within the State. (Ord. 328, 1-12-1971)
There is hereby adopted for the purposes of establishing rules and regulations for the use of all streets and public thoroughfares of the City that certain code, identified as the 1969 revised edition, Idaho Motor Vehicle Laws, more particularly title 49, Idaho Code, published by the Department of Law Enforcement, and as the same may hereafter be revised by the Idaho Legislature or amended by the governing body, and the same is hereby adopted and incorporated as an ordinance of the City as fully as though set forth at length herein.
Three (3) copies of the Idaho Motor Vehicle Laws, together with any revisions or amendments, duly certified by the City Clerk-Treasurer, shall be kept on file in his office for use and examination of and by the public. (Ord. 328, 1-12-1971)
A. Certain Vehicles Restricted:
1. Load Restrictions: When signs are erected by authority of the City Council giving notice thereof, it shall be unlawful for any person to operate any vehicle with a gross weight in excess of the amounts specified.
2. Use Restrictions:
a. The City Officer is hereby authorized to determine and designate those heavily-traveled streets upon which shall be prohibited the use of the roadway by motor-driven cycles, bicycles, horse-drawn vehicles or other nonmotorized traffic and shall erect appropriate signs giving notice thereof.
b. When signs are so erected giving notice thereof, it shall be unlawful for any person to disobey the restrictions stated on such signs.
B. Speed Limits: Every person operating a motor vehicle on the public streets or alleys of the City shall drive the same in a careful and prudent manner, and, unless otherwise posted, the speed of said vehicle shall not exceed twenty (20) miles per hour in general; and, along school grounds, shall not exceed fifteen (15) miles per hour; and, in a public park area, shall not exceed fifteen (15) miles per hour; and, in no case, at a rate of speed that will endanger the property of another for the life and limb of a person.
C. Funeral And Other Processions:
1. Driving Through Funeral Or Other Procession: It shall be unlawful for a driver of a vehicle to drive between vehicles comprising a funeral or other authorized procession while they are in motion and when such vehicles are conspicuously designated.
2. Drivers In A Procession: Each driver in a funeral or other procession shall drive as near to the right-hand edge of the roadway as practical and shall follow the vehicle ahead as close as is practical and safe.
3. Funeral Processions To Be Identified: A funeral composed of a procession of vehicles shall be identified by display of lights or other identifying insignia or by such other method designated by the City Officer.
D. Prohibited And Restricted Acts:
1. Following Fire Apparatus Prohibited: It shall be unlawful for any driver of any vehicle, other than one on official business, to follow any fire apparatus traveling in response to a fire alarm closer than five hundred feet (500'), or drive or park such vehicle within the block where fire apparatus has stopped in answer to a fire alarm.
2. Crossing Fire Hose: It shall be unlawful for any person to drive or permit any vehicle to be driven over any unprotected hose of the Fire Department when laid down on any street or private driveway to be used at any fire or alarm of fire without the consent of the Fire Department official in command.
3. Vehicles On Sidewalks: It shall be unlawful for the driver of a vehicle to drive within any sidewalk area except at a permanent or temporary driveway. No vehicle shall be parked within any sidewalk area.
4. Limitations On Backing: It shall be unlawful for any driver of a vehicle to back the same unless such movement can be made with reasonable safety and without interfering with other traffic.
5. Riding On Motorcycles: A person operating a motorcycle shall ride only upon a permanent and regular seat attached thereto, and such operator shall not carry any other person nor shall any other person ride on a motorcycle unless such motorcycle is designed to carry more than one person.
6. Clinging To Vehicles: It shall be unlawful for any person riding upon a bicycle, coaster, roller skates, roller blades, skateboard, sled, or toy vehicle to attach the same or himself or herself to any vehicle upon a roadway.
7. Use Of Privately-Owned Property To Avoid Signs: It shall be unlawful for any person to use privately-owned property for the purpose of avoiding compliance with the traffic signs and signals within the City limits.
Nothing in this subsection, however, shall be construed to prevent or prohibit the lawful use of said premises.
E. Penalty: Any violation of any of the provisions of the Idaho Motor Vehicle Laws (Ordinance 328, 1-12-1971) and this Section shall be subject to penalty as provided for in Section 1-4-1 of this Code. (Ord. 458, 12-10-1996)
