(a) Busses, trucks, commercial tractors, trailers, semitrailers and pole trailers, respectively, when operated upon any street or highway, shall be equipped as required by such regulations and such equipment as authorized by the Ohio Director of Highway Safety and shall be lighted at all times mentioned in Section 337.02, except that clearance and side marker lights need not be lighted on any such vehicle when operated within the Municipality where there is sufficient light to reveal any person or substantial object on the highway at a distance of 500 feet.
Such equipment shall be in addition to all other lights specifically required by this Traffic Code.
Vehicles operated under the Public Utilities Commission of Ohio shall not be subject to the requirements of the regulations provided for by this section.

(b) Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
