§ 97.99  PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   Any person, firm or corporation that violates any provision of §§ 97.01 through 97.08 of this chapter, either individually or by or through his, her, its or their servants, agents or employees acting under and pursuant to his, her its or their orders or directions, and every servant, agent or employee and every other person who violates any provision of §§ 97.01 through 97.08 of this chapter, shall be fined for each offense in any sum not more than $10.
   (C)   Any person, corporation or thing violating the provisions of § 97.09 of this chapter shall be subject to a fine of not more than $10 or § 97.09 of this chapter may be enforced by injunction.
   (D)   With regard to any pole and conduit attachment licensing agreement (§ 97.26) between the permittee and the town, the penalty for an unauthorized attachment shall equal five times the annual attachment fee, per occurrence; the penalty for failure to timely transfer, abandon, or remove facilities from a pole shall equal one-fifth of the annual attachment fee per day, per pole, for the first 30 days; after the initial 30 days, the penalty shall be equal to the annual attachment fee per day, per pole, thereafter; and the penalty for failure to timely transfer, abandon, or remove facilities from a utility conduit system shall equal one-fifth of the annual conduit fee per day, per linear foot, for the first 30 days; after the initial 30 days, the penalty shall be equal to the annual conduit fee per day, per linear fool, thereafter. Notwithstanding any pole and conduit attachment licensing agreement between the permittee and the town, any person, trust, corporation or legal entity who shall violate any of the provisions of § 97.26 or other lawful order or regulation of the town for which another penalty is not provided shall be civilly liable a fine of not less than $100 or more than $500, plus the cost of the required permit, in the discretion of the Town Manager. Each day and each violation that any person, trust, corporation or legal entity shall commit shall constitute a separate offense and be liable as such.
