FIRE PENSION BOARD
The following definitions shall apply throughout this subchapter, as the same may hereafter be amended from time to time, namely:
“CHIEF.” The Chief of the Town of Cedar Lake Municipal Fire Department, or his or her designee, unless context clearly indicates otherwise.
“FIRE DEPARTMENT.” Collectively, the Town of Cedar Lake Municipal Fire Department, and its qualified full-time personnel, unless context clearly indicates otherwise.
“INPRS.” The Public Employees Retirement Fund established pursuant to IC 5-10.3-1 et seq., as amended from time to time.
“LOCAL BOARD.” The Fire Pension Board of the Town of Cedar Lake.
“LOCAL STANDARDS” or “STANDARDS.” Standards developed by the Local Board for establishing a passing grade or score on agility, mental, and physical examination required by IC 36-8-3.2 et seq., as amended from time to time, for admission to the 1977 Town Firefighters’ Pension & Disability Fund.
“MEMBER OF THE FIRE DEPARTMENT”, “ACTIVE MEMBER”, or “MEMBER.” A qualified full-time, paid employee of the Town of Cedar Municipal Fire Department, including the Chief.

(A) There is hereby established in the Town of Cedar Lake a Fire Pension Board, which Local Board shall perform the following duties, and fulfill specific responsibilities as set forth hereinafter, namely:
(1) Establish the standards for passing the physical agility test, general aptitude test, and physical examination required for admission of a new employee to NPRS;
(2) Certify that an NPRS applicant for employment has passed those examinations listed in subsection (A)(1) above;
(3) Determine whether member(s) of the Fire Department are entitled to leave of absence for the purposes of disability;
(4) Determine whether a member of the Fire Department has a covered impairment as defined by IC 36-8-8-12.3, as amended from time to time, which makes the member unable, either temporarily or permanently, to perform the member’s duties with the Fire Department;
(5) Hear and determine all applications for relief or pensions;
(6) Make all rules necessary for the discharge of its duties; and
(7) All other duties imposed upon the Local Board by applicable law.
(B) The members of the Local Board shall serve with no compensation for such services.

The Trustees of the Local Board shall be as follows:
(A) The Town Council President and the Chief, who shall be ex-officio members, and shall be entitled to vote on any matter, and shall be counted towards a quorum at any meeting of the Local Board;
(B) When there are three (3) or more retired members of the Fire Department, one (1) trustee shall be elected for a two (2) year term from among those retired members, in accordance with § 35.20 below; and
(C) Four (4) active members of the Fire Department who shall each be elected to four (4) year terms, in accordance with § 35.12 below.

(A) The first election of the Fire Department Member Trustees shall be held within sixty (60) days of the effective date of this subchapter. The Chief shall post a notice in one (1) or more prominent locations at a designated fire station setting the date, time and place of the meeting to nominate candidates and elect trustees of the Local Board. Such notice shall be posted at least forty-eight (48) hours in advance of the scheduled meeting.
(B) At said scheduled meeting, the members of the Fire Department shall nominate candidates from among their membership for election to the Local Board. Immediately thereafter, the members shall vote for four (4) candidates; the four (4) candidates with the most votes shall serve as Trustees of the Local Board.
(C) The Trustees so elected shall serve staggered terms of one (1), two (2), three (3) and four (4) years. A member’s assignment to a particular term shall be determined by lot.
