§ 35.012 TOWN OF WALTON AND TOWN OF GALVESTON AS MEMBERS OF THE DEPARTMENT.
   The Town of Galveston became a member and participant in the Logansport/Cass County Planning Department.
   (A)   As a member, the town shall receive from the Department:
      (1)   Routine day-to-day planning services, such as agenda preparation for the Plan Commission and Board of Zoning Appeals, staff reports for the same, application filings, and assistance with town annexation efforts, if requested, and with the preparation of grant applications;
      (2)   Attendance at all Town Plan Commission and Board of Zoning Appeals meetings by one or more Department staff;
      (3)   Assistance with the preparation of a revised Comprehensive Plan, Zoning Ordinance, and Subdivision Control Ordinance;
      (4)   Building Inspection services for major construction to the extent the service is provided to the county as specified herein. MAJOR CONSTRUCTION shall mean commercial, industrial, multi-family residential, institutional, or public buildings;
      (5)   Membership of the Galveston Plan Commission President as a voting member of the Department Executive Committee, as further specified § 35.006. If the President cannot attend, he or she may designate another Plan Commission member to attend on his or her behalf; and
      (6)   Participation by the Galveston Plan Commission President and the Galveston Board of Trustees President in the bi-yearly meeting which reviews the on-going work program of the Department, as further specified hereby.
   (B)   (1)   For the above services, the town agrees to pay yearly the sum of $900, which equals $0.50 per capita for each town resident based upon the most recent census (182,220).
      (2)   If zoning administration is ever requested, an additional $0.50 per capita shall be required. Of this amount, $450 shall be paid yearly to the City of Logansport, and $450 of this amount shall be paid yearly to Cass County.
      (3)   This amount shall be adjusted following each census. For special services not listed above, the town may also contract with the Logansport/Cass County Planning Department on a case-by-case basis to provide that service. However, the special service shall be included in the yearly work program adopted by the Department.
      (4)   The town shall also pay for any publishing costs and the costs associated with the printing of any forms and permits. The town may set their own fee schedule and may retain all fees charged.
   (C)   (1)   The Town or the Logansport/Cass County Planning Department may terminate this agreement prior to January 1 of any year by written notification to the other party.
      (2)    The town of Galveston adopts by reference the ordinance establishing the Logansport/Cass County Planning Department, which was originally adopted by the Board of County Commissioners on September 17, 1984, and the Logansport Common Council on October 1, 1984, (City Ordinance 84-17), and which was subsequently amended in 1987 by the city and county (City Ordinance 87-29) and the City, County, and Town of Walton in 1988 (City Ordinance 88-4). The original ordinance creating this section shall be in full force and effect from and after its adoption by the Logansport Common Council, the Board of County Commissioners, the Walton Board of Trustees, and the Galveston Board of Trustees.
