8.08.200 Violations; enforcement.
   Nothing in this chapter shall imply or mandate that the Casa Grande Municipal Landfill accept or retain refuse, waste, or specially treated solid waste that is otherwise prohibited or not permitted to be accepted in accordance with state statutes or regulations.
   A.   The City may reject collection or may return Landfill disposal of refuse from users who do not comply with the requirements of this chapter.
   B.   If the City has refused collection or returned a particular location's refuse three times in any 180-day period for non-compliance with the requirements of this chapter, the City may suspend the user's ability to use the Landfill until the user shows sufficient and relevant evidence of compliance with this chapter such that the City can be reasonably assured that non-compliance will not reoccur. Upon resumption of the suspended use of Landfill for repeated violations, and upon resumption, if any, of the City's collection activities for that user, the user must post financial assurance(s), in the form approved by the City Attorney, which are twice the amount of the last billing for that type of refuse or waste.
   C.   Upon ten days written notice to the user of intent to revoke Landfill privileges and of a time for a meeting with the public services director, the City may revoke the user's Landfill rights after more than two suspensions of Landfill privileges within any eighteen-month time period.
