8.08.180 Refuse accumulation unlawful.
   A.   It is unlawful for any person to permit or suffer to accumulate in or about any yard, lot, place or premises, or upon any street, alley, or sidewalk adjacent to the lot, yard, place or premises, owned or occupied by the person, any garbage or refuse so as to cause the yard, lot, premises, or the street, alley or sidewalk adjacent thereto to be or remain in such condition as to cause or create a nuisance or offensive odor or atmosphere, or thereby to be or become, or cause or create, a public nuisance.
   B.   It is the responsibility of the owner or legal occupant of the property to trim trees or shrubbery on their property and in the adjacent right-of-way, when such vegetation interferes with the movement of solid waste collection vehicles. Upon a violation of this section, an inspector shall issue a notice of violation to the responsible party to trim or remove the vegetation. Failure to do so within ten calendar days after the notice has been issued may result in the City's removal of the vegetation, and billing the owner/occupant (and possibly imposing a lien on the property) for the City's costs of removal.
