17.56.270 Joint use parking requirements.
   A.   Joint use parking permitted. Off-site parking to meet the required spaces outlined in this chapter is permitted for the following uses:
   1.   Churches and auditoriums within 300 feet of approved commercial uses
   2.   Adjacent uses which are eligible to utilize shared parking factor table
   B.   Churches and auditoriums eligible for shared use. Up to 80% of the parking spaces required by this section for a church or auditorium incidental to a public or parochial school may be supplied by the off-street parking facilities of general retail, office, and business service uses, other uses which realize at least 80% of their parking demand during daytime hours, or other uses as allowed by the Director.
   C.   Compatible adjacent uses eligible to utilize shared parking factor table. Uses which typically have off-setting demands in parking use throughout daily operation may complete joint use parking agreements using the shared parking factors outlined in Table 17.56.270. When 2 adjacent sites are eligible for such an agreement, each site may divide its minimum required parking stalls by the factor identified in Table 17.56.270. All agreements leveraging the parking factor tool must meet all other relevant conditions for joint use in this section. This arrangement is designed to promote shared parking between compatible uses in new construction.

   D.   Conditions required for joint use parking. All joint use parking arrangements are subject to the following conditions:
   1.   The building or use for which the application is being made to utilize the off-street parking facilities provided by another use shall be located within 300 feet of the parking facilities.
   2.   The applicant shall demonstrate that there is no substantial conflict in the hours of operation between the two buildings or uses which will impede adequate parking provision for which the joint use parking arrangement is proposed.
   3.   A properly drawn legal agreement executed by the parties concerned for a joint use of off-street parking facilities, shall be approved by the Director and recorded with the County Recorder.
   4.   Joint use parking arrangements shall be binding with both properties for the duration of both original principal uses.
