The bidding requirements in this chapter shall not apply in the following instances:
A. An emergency purchase permitted pursuant to Section 3.04.070;
B. A purchase where the state, another city or town, a school district or another governmental agency has procured a contract through properly conducted public bidding, and permits the city to participate in such contract; provided such bidding meets the requirements of Subsection 3.04.230.B.;
C. A purchase from the United States or an agency thereof, the state or an agency thereof, or any county or local government in this state;
D. An agreement for professional or technical services, although the purchasing officer may require the submission of proposals prior to engaging such services;
E. This chapter shall not be construed to prohibit the purchase of supplies, materials, equipment, services and improvements when circumstances render the bidding procedures impractical.
1. Examples of these situations are equipment repairs in which substantial work must be performed before a precise cost estimate can be made, purchase of equipment at public auction and public bids, and the purchase of used equipment.
2. The purchasing officer shall establish regulations limiting and defining the conditions under which the exemptions provided herein shall apply.
