§ 111.082  VIDEO GAMING DEVICES IN CONVENIENCE STORES.
   (A)   Generally. In addition to those lawful places for use of video gaming devices in and upon premises used or occupied as a place where alcoholic liquor is sold or given away as provided in the Illinois Video Gaming Act, convenience stores in the city holding a valid Class AC1 retail license, shall be a lawful place for use of video gaming devices. This class of retail liquor licenses shall be in addition to those classes provided for in § 111.020 of this chapter.
   (B)   Definition. For purposes of this Class AC1 retail license, a CONVENIENCE STORE shall mean a small-size retail business and gas station establishment that sells gasoline, fuel and petroleum products, and a limited range and selection of household goods, grocery items, deli food, snack food, confectionery, soft drinks and beverages, alcoholic liquor for consumption off the premises, tobacco products, over-the-counter medications, health and beauty aids, toiletries, newspapers, magazines, and other similar convenience items.
   (C)   Class AC1 retail license.
      (1)   This license shall permit convenience stores (as defined in division (B) above) to sell alcoholic liquor at retail for consumption on the licensed premises. This shall only be allowed in a separated designated room, were video gaming terminals are located. This room shall allow customers to scan a valid ID card to gain access. It will also be equipped with video surveillance that can be viewed by the clerk on duty. The licensee must provide a separate address for the gaming room (such as, “Suite A”) for the purpose of this license, and register same with the United States Post Office located in the city.
      (2)   Procedures must be in place and in accordance with the city and Illinois Gaming Commission as to the consumption on premises of alcoholic beverages as follows: alcohol can only be consumed in the gaming area at the rate of one drink per hour. The customer shall make contact with the clerk who must be 21 years of age to make the sale. The clerk will then deliver the beverage, taken from a designated cooler to the gaming room and serve it therein. Licensee must post signs that say, “no alcohol consumed outside of the designated gaming room” and “no outside alcohol may be consumed in the designated gaming room.”
   (D)   License fee. The annual license fee for such Class AC1 shall be $550; provided however, a fee of $450 shall be added for a Sunday license.
