ADOPTING ORDINANCE
ORDINANCE NO. 21-654
AN ORDINANCE ADOPTING AND ENACTING A REVISED AND RECODIFIED CODE
OF ORDINANCES FOR THE CITY OF CARROLLTON, REVISING, AMENDING,
RESTATING, RECODIFYING, AND COMPILING THE EXISTING ORDINANCES OF
THE CITY; PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT
INCLUDED THEREIN, EXCEPT AS HEREIN EXPRESSLY PROVIDED; AND
PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE
WHEREAS, the present code of ordinances of the City of Carrollton are in need of reorganization and recodification in order to continue to protect the public peace, health, safety, and general welfare of the municipality and its citizens, and for the proper conduct of its affairs; and
WHEREAS, the Acts of the Legislature of the State of Illinois empower and authorize the City to revise, amend, restate, recodify, and compile any existing ordinances and all new ordinances not heretofore adopted or published and to incorporate such ordinances into one code of ordinances in pamphlet/book form; and
WHEREAS, the Mayor and City Council of the City have authorized a general compilation, revision, and recodification of the code of ordinances of the City and publication of such code of ordinances in pamphlet/book form;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF CARROLLTON, ILLINOIS AS FOLLOWS:
Section 1. The general ordinances and code of ordinances of the City of Carrollton, as hereinafter revised, amended, restated, recodified, and compiled in pamphlet/book form are hereby adopted and enacted as the Carrollton Code of Ordinances and are a new and comprehensive Code of Ordinances for the City through and including Ordinance No. 21-651 passed and approved by the corporate authorities on September 9, 2021.
Section 2. This Code of Ordinances as adopted and enacted in Section 1 of this ordinance and as fully set out herein and as attached hereto shall consist of the following Titles: Titles I: GENERAL PROVISIONS, III: ADMINISTRATION, V: PUBLIC WORKS, VII: TRAFFIC CODE, IX: GENERAL REGULATIONS, XI: BUSINESS REGULATIONS, XIII: GENERAL OFFENSES, XV: LAND USAGE, and TABLE OF SPECIAL ORDINANCES, the specific provisions of which are more fully listed in the Table of Contents that follows on pages 1 through 4 of this code, with the contents of each title being more fully indexed at the beginning of each Chapter of each title of this code, said Chapters being organized by subject matter as they pertain to the subject matter of each title.
Section 3. All prior ordinances pertaining to the subjects treated in this Code of Ordinances shall be deemed repealed from and after the effective date of this ordinance except as they are included and re-ordained in whole or in part in this Code; provided, such repeal shall not affect any offense committed or penalty incurred or any right established prior to the effective date of this ordinance, nor shall such repeal affect the provisions of ordinances levying taxes, appropriating money, annexing or detaching territory, establishing franchises, or granting special rights to certain persons, authorizing public improvements, authorizing the issuance of bonds or borrowing of money, authorizing the purchase or sale of real or personal property, granting or accepting easements, platting or dedicating land to public use, vacating or setting the boundaries of streets or other public places; nor shall such repeal affect any other ordinance of a temporary or special nature or pertaining to subjects not contained in or covered by this Code.
Section 4. The official copy of the Carrollton Code of Ordinances shall be kept on file in the office of the City Clerk. It shall be the expressed duty of the City Clerk or someone authorized by said Clerk to update the official copy of the Code, to keep a record of the location and who is in possession of all additional copies of the Code, and to prepare updates for all additional copies, wherever located, whenever the Code is amended by any action of the corporate authorities. The official copy of the Code shall be available for inspection and use by the public only at City Hall under direction of the City Clerk.
Section 5. This Code of Ordinances shall be in full force and effect as provided in Section 6, and this code of ordinances shall be presumptive evidence in all courts and places of the validity of the Code of Ordinances and all provisions, sections, penalties, and regulations therein contained, and of the date of passage, and that the same is properly signed, attested, and approved, and that any public hearings have been held and notices thereof as required by law have been given.
Section 6. This Code of Ordinances shall be in full force and effect from and after its passage, approval, and publication in pamphlet book form, pursuant to law.
