10-2-1: DEFINITIONS:
For the purpose of this Chapter, the following terms, phrases, words, and their derivations shall have the meaning given herein. When not consistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
   AIRCRAFT: Any contrivance now known or hereafter invented, used or designated for navigation or for flight in the air. The word "aircraft" shall include all helicopters and lighter-than-air dirigibles and balloons.
   AUTHORIZED PRIVATE RECEPTACLE: A litter storage or collection container as described in Section 10-1-8 of this Chapter.
   BACKYARD COMPOSTING FACILITY: An area enclosed by wood, wire mesh, concrete blocks, metal drum or other suitable material designed only for depositing compostable waste for the production of compost. Such a facility shall be located no closer to the street than the principal building on the property.
   CITY: The City of Carbondale, Illinois.
   COMPOST: The humus-like product of the process of composting waste which may be used as a soil conditioner or mulch.
   COMPOSTABLE WASTE: Organic plant material including leaves, grass, weeds, garden waste, vegetables, fruit, brush and twigs less than one-half inch (1/2") in diameter. Kitchen wastes which include grease, fat, meat, bones, whole eggs or dairy products are not acceptable compost materials. Human or pet feces are also not acceptable compostable materials.
   COMPOSTING: The biological treatment process by which microorganisms decompose organic material producing compost.
   GARBAGE: Putrescible animal and vegetable wastes resulting from the handling, preparation, cooking, disposal and/or consumption of food.
   HANDBILL: Any printed or written matter, any sample or device, dodger, circular, leaflet, pamphlet, paper, booklet, or any other printed or otherwise reproduced original or copies of any matter of literature:
   A.   Which advertises for sale any merchandise, product, commodity, or thing; or
   B.   Which directs attention to any business or animal or commercial establishment, or other activity, for the purpose of either directly or indirectly promoting the interest thereof by sales; or
   C.   Which directs attention to or advertises any meeting, theatrical performance, exhibition, or event of any kind; or
   D.   Which, while containing reading matter other than advertising matter, is predominantly and essentially an advertisement, and is distributed or circulated for advertising purposes, or for the private benefit and gain of any person so engaged as advertiser or distributor.
   LITTER: "Garbage", "refuse", and "rubbish" as defined herein and all other waste material which, if thrown or deposited as herein prohibited, tends to create a danger to public health, safety and welfare or detracts from the appearance of the community.
   MULCH: Shredded leaves, grass clippings and shredded wood products properly used to provide a cover around trees, shrubs, garden areas and plant beds for the purpose of retarding weed growth, retaining moisture, providing fertilizer or other landscaping purposes.
   NEWSPAPER: Any "newspaper" of general circulation as defined by general law, any newspaper duly entered with the Post Office Department of the United States, in accordance with Federal status or regulation, and any newspaper filed and recorded with any recording officer as provided by general law; and, in addition thereto, shall mean and include any periodical or current magazine regularly published with not less than four (4) issues per year, and sold to the public.
   OWNER: Any person or entity who shall have a legal, equitable or beneficial interest in the subject real estate, or any improvements thereto; or a reversionary leasehold interest in the subject real estate, or any improvements thereto; or a capacity to manage the subject real estate or any improvements thereto pursuant to an order of court, power or agreement.
   PARK: A park, reservation, playground, beach, recreation center or any other public area in the City, owned or used by the City or other unit of government and devoted to active or passive recreation.
   PERSON: Any person, firm, partnership, association, corporation, company or organization of any kind.
   PRIVATE PREMISES: Any dwelling, house, building, or other structure designed or used either wholly or in part for private residential purposes, whether inhabited or temporarily or continuously uninhabited or vacant, and shall include any yard, grounds, walk, driveway, porch, steps, vestibule or mailbox belonging or appurtenant to such dwelling, house, building, or other structure.
   PROPERTY HELD OUT TO THE PUBLIC FOR THE TRANSACTION OF BUSINESS OR RECREATION: Includes but is not limited to drive-in restaurants, automobile service stations, business parking lots, car washes, shopping centers, industrial parking lots, shopping malls, commercially operated parks, or drive-in movies.
   PUBLIC PLACE: Any and all streets, sidewalks, boulevards, alleys or other public ways and any and all public parks, squares, spaces, grounds, and buildings.
   PUBLIC RECEPTACLE: A litter storage or collection receptacle placed, authorized, or caused to be placed by the City or other unit of government in a public place.
   REFUSE: All putrescible and nonputrescible solid wastes (except body wastes), including but not limited to garbage, rubbish, ashes, street cleanings, plastic products, grass clippings, leaves, concrete, bricks, lumber, appliances, furniture, dirt, tree limbs, abandoned automobiles and parts thereof, solid market and industrial wastes, etc.
   RUBBISH: Nonputrescible solid wastes consisting of both combustible and noncombustible wastes, such as paper, wrappings, cigarettes, cardboard, tin cans, yard clippings, leaves, wood, glass, bedding, crockery and similar materials.
   VEHICLE: Every device in, upon, or by which any person or property is or may be transported or drawn upon a highway, including devices used exclusively upon stationary rails or tracks. (1998 Code)
