10-1-8: CONTAINERS, PREPARATION AND STORAGE OF REFUSE:
   A.   Criteria For Containers: All residential and commercial garbage shall be kept in containers which meet the following criteria: constructed of rigid plastic or metal; provided with insect and rodent proof covers; free of holes, cuts, or tears; and watertight. The covers shall be tightly placed on the container so as to keep it closed whenever there is garbage in the container. There shall be sufficient containers to hold all the garbage accumulating on the premises between collections. Garbage from the residences shall be drained, wrapped in paper or placed in sanitary bags, and kept dry in an approved container until removal by the City or a licensed collector (except as indicated in section 10-1-10 of this chapter when set out for collection). All containers shall be maintained in a good and sanitary condition by the owner thereof.
   B.   Storage Within An Enclosed Building: All nongarbage residential and commercial refuse when stored within a completely enclosed building shall be kept in containers described in subsection A of this section or in some other enclosure such as a closed plastic bag that will allow for orderly storage without creating a harborage for insects and rodents.
   C.   Outdoor Storage Of Residential Refuse: All residential refuse when stored outdoors or not in a completely enclosed building shall be stored as follows:
      1.   All residential garbage shall always be stored as required in subsection A of this section.
      2.   All other residential refuse except leaves, grass rakings, sticks, and tree limbs, when stored outdoors or not in a completely enclosed building, shall be stored in containers described in subsection A of this section.
      3.   All residential refuse and refuse containers when not in a completely enclosed building shall be placed and kept at all times on private property adjacent to the owner and occupant's house or building or building at a location which is not between the front of the dwelling or building and the adjoining street. If stored beside rather than behind the dwelling or building, such refuse and refuse containers shall be screened from view from the street. In the case of a corner lot, the dwelling or building shall be considered to have two (2) fronts and the determination of side versus rear of the structure shall be by prevailing yard patterns in the block. In the case of a "through lot or double frontage lot" as defined in section 15.11.4 of this Code, front versus rear will be determined by prevailing yard patterns.
      4.   Combustible materials such as sticks, tree limbs and lumber when not stored in approved containers shall be stored a sufficient distance from the house or building so as to not create a fire hazard that would endanger the house or building.
   D.   Outdoor Storage Of Commercial Refuse: All commercial refuse when stored outdoors or not in a completely enclosed building shall be stored as follows:
      1.   All commercial garbage shall always be stored as required in subsection A of this section.
      2.   All other commercial solid waste shall be stored in closed dumpsters, closed garbage cans, or equivalent closed containers unless such refuse is stored in a completely fenced and visually screened area of sufficient height to preclude access by animals and to avoid wind blown dispersal of such refuse.
      3.   No commercial refuse containers shall be stored on public rights-of-way. Provided, however, that in the case of structures in the downtown area where buildings were heretofore built up to all the property lines, dumpsters or other containers may be stored at the edge of an alley only as long as such containers do not obstruct traffic and only if such dumpsters or containers are fastened by chains, cables, or similar devices to the buildings so as to prevent the dumpsters or containers from being accidentally or mischievously pushed into the trafficway. The location and placement of such containers is subject to the approval of the Public Works Director or his designee. The owner of the building and the tenant(s) of the building are responsible to see that the dumpsters are properly fastened to the building. The Public Works Director or his designee may remove any commercial refuse container stored on public right-of-way not in compliance with the terms of this subsection D3.
      4.   Commercial refuse containers shall not be stored between a building and a street adjoining the property upon which the building is situated unless the containers are stored in an enclosure designed to screen the containers from view from the street.
      5.   Properties for which a site plan has been approved shall have refuse stored only in the manner and location approved in the site plan.
   E.   Construction And Remodeling Debris: Construction and remodeling debris produced during an active construction or remodeling project may be stored in commercial containers such as large dumpsters without lids as long as provisions are made to prevent blowing of debris.
   F.   Leaves And Grass Rakings: Leaves and grass rakings may be stored in high strength bags which are tightly fastened.
   G.   Sticks And Tree Limbs: Sticks and tree limbs may be stored in tied bundles.
   H.   Storage Of Recycling Bins: Recycling bins provided by the City or a special collector shall be stored in a completely enclosed building. (Ord. 2017-24)
