A. Authorized Collectors; Days And Hours For Collection: The owner and/or person in control of and/or occupying any building and/or premises shall provide for the collection of refuse from said building and/or premises in compliance with the provisions of this chapter. All residential refuse, except recyclable material and landscape waste, shall be removed and disposed of by the City or a licensed collector once each week, with an interval of at least two (2) days between each collection. The City shall make no collection on Sundays or holidays designated by the City. Further, all collections made by the City or a licensed collector shall be made in sections of the City zoned primarily for residential uses as stated in sections 15.2.9 through 15.2.16 of this Code only between the hours of six o'clock (6:00) A.M. and eight o'clock (8:00) P.M. It shall be the responsibility of the owners and/or persons in control of and/or occupying any commercial establishments to collect, remove, and dispose of all commercial refuse and landscape waste; provided, however, that if no reasonable method of collection, removal, or disposal can be found, the City may remove such refuse by special agreement with such commercial owner and/or person.
B. Same Day Collection: Whenever a curbside recycling program operated by the City or a special collector authorized by the City is in effect, recyclable material shall be collected in each area of the City on the same day of the week as the City refuse collection in that area.
C. Recyclable Material: Whenever a recycling program operated by the City or an authorized special collector is in effect, occupants of dwellings which produce residential refuse may place authorized recyclable material at curbside for collection by the City or special collector if recycling bins have been provided to the residence by the City or special collector. Recyclable materials to be placed at curbside for collection shall comply with the requirements for collection as specified in section 10-1-10 of this chapter. The curbside collection as specified is available to occupants of dwellings which produce residential refuse whether or not such dwelling receives curbside refuse pick up service from the City. Occupants of dwellings which produce refuse other than residential refuse shall remove the recyclable material periodically from premises so as to not constitute an accumulation of material that would be hazardous to the health, safety or welfare of the occupants or to the general public.
D. Landscape Waste: Landscape waste and/or yard waste shall be removed from each occupied building and/or premises by a licensed collector once every thirty (30) days or more frequently as volume exceeds storage capacities.
1. No owner and/or person may knowingly mix other refuse with landscape waste or yard waste that is intended for collection and/or final disposal at a landscape waste processing facility or by means of land application.
2. No owner and/or person may knowingly mix landscape waste or yard waste with other refuse that is intended for collection and/or final disposal at a sanitary landfill.
It is not the intent of this provision to prohibit composting of landscape and/or yard waste as permitted by chapter 2 of this title. (Ord. 2017-24)
