8-10.1-14: PENALTY:
Any person, corporation, or association violating any provision of this chapter shall be deemed guilty of an offense and, upon conviction, shall be punished by a fine not less than fifty dollars ($50.00) and not to exceed two hundred dollars ($200.00) for each violation. Each day or portion thereof a violation continues shall be deemed a separate violation. The violation of each provision, and each separate violation thereof, shall be deemed a separate offense, and shall be punished accordingly. However, compliance may be further sought through injunctive relief in the district court. (Ord. 1231, 2-21-1989)
8-10.1-15: EXCESS WATER USE; BILLING:
Any person, corporation, association, or bulk water purchaser (to include municipal bulk purchasers) who use water in excess of the reduced monthly average imposed in stage 3 or in stage 4 of this chapter shall be billed by the city for such excess water use at triple the normal rate applied to such person, corporation, association or bulk water purchaser for such excess use. All other water used in conformity with this chapter shall be billed at the normal rate(s). All such charges shall be billed as part of the consumer's regular water bill. Failure to pay such bill when due, to include triple charges for excess water use, shall result in the imposition of the normal late payment charge and ultimate termination of water use in conformity with the applicable provisions of this code. The excess water use billing rates established by this section are in addition to the penalties provided by section 8-10.1-14 of this chapter. (Ord. 1231, 2-21-1989)
8-10.1-16: ADDITIONAL REQUIREMENTS AND RESTRICTIONS:
   (A)   Implementation of stage 3, mandatory compliance - water warning, shall be implemented and fully enforced commencing at seven o'clock (7:00) A.M. local time on Thursday, July 6, 1989.
   (B)   As of seven o'clock (7:00) A.M. local time on Thursday, July 6, 1989, the bulk purchases of water supplied by or through the city shall be limited to an aggregate of two hundred fifty (250) gallons per day per household. Further, the price to be charged for each unit of bulk sales, or portion thereof, shall be three (3) times the normal cost.
   (C)   Except for existing sanitation uses at Lake Canton, no water shall be taken by any person directly from Lake Canton or from any other municipal water source. A violation of this subsection shall be subject to the penalty provided by section 8-10.1-14 of this chapter.
   (D)   Effective as of seven o'clock (7:00) A.M. local time on Thursday, July 6, 1989, each city water account shall be allowed four hundred (400) cubic feet (2,992 gallons) of water per billing period (every 2 months) which shall not be subject to the rationing requirements of stages 3 and 4 of this chapter.
   (E)   The mayor may, by executive order, establish other and/or further rules and regulations as may by the mayor seem reasonably necessary to the implementation of this chapter and to the implementation of this section. Specifically, executive order no. 89-01 issued on or about June 28, 1989, is hereby approved by the city council. (Ord. 1250, 7-5-1989)
