For the purpose of this subchapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
PERSON. Any individual, association, partner-ship, or corporation, or the operator for or the agent of any such person, who sells to the public at retail any goods, wares, commodities, or merchandise, excluding nonprofit or civic organizations engaged in sales as fund raising activities for which the individual persons offering the goods or services receive no compensation.
TEMPORARY STORE. A store, storeroom, office, or other permanent nonmovable structure opened and maintained for the sale to the public of goods, wares, commodities, or merchandise, where the seller or owner of the goods, wares, commodities, or merchandise operates the store, storeroom, office, or permanent nonmovable structure for a period of less than 120 days.
TRANSIENT VENDORS. Any person who sells to the public goods, wares, commodities, or merchandise from a place other than a store, storeroom, office, or other permanent nonmovable structure shall be considered a TRANSIENT VENDOR.
