§ 50.027 PRETREATMENT OPERATION COST MAINTAINED BY OWNER.
   (A)   Where installed, preliminary treatment facilities, all grease, oil, and sand interceptors shall be maintained by the owner, at his expense, in continuously efficient operation at all times.
   (B)   Industrial users shall operate their wastewater treatment facilities at all times. All bypasses of pretreatment facilities are prohibited and all industrial users are subject to the penalties in § 50.999 unless:
      (1)   Bypass is unavoidable to prevent loss of life, personal injury or severe property damage;
      (2)   There are no feasible alternatives to the bypass, for example, use of auxiliary treatment facilities, retention of untreated waste or normal preventative maintenance during equipment downtime;
      (3)   The user submitted the notices discussed below and received authorization from the Director.
   (C)   The Director may only approve an anticipated bypass of pretreatment facilities after considering its adverse effects, and if the Director determines:
      (1)   The bypass will not cause violation of Categorical Pretreatment Standards or any provision of this chapter; and
      (2)   The bypass is for essential maintenance to ensure the efficient operation of pretreatment facilities.
   (D)   If a user knows in advance of the need for bypass, he shall submit a written notice to the Director at least ten days before the date of the bypass, and shall not permit the bypass without the Director's authorization. If a user experiences an unanticipated bypass which exceeds Pretreatment Standards, he shall notify the Director within 24 hours from the time he becomes aware of the bypass, and shall submit within five days of verbal notification, a written report describing the bypass event and its cause; the bypass duration, including exact times and dates; and if the bypass has not been corrected, the time it is expected to continue and measures taken to reduce, eliminate and prevent is recurrence. The Director may waive the written report if the verbal-report is received within 24 hours.
