§ 3-40 COURT PROCEEDING AGAINST VICIOUS OR DANGEROUS DOGS.
   1.   The owner of any dog alleged to be dangerous may be charged in Municipal Court after a complaint has been duly filed therein by any person having knowledge thereof. If the court finds that the dog has attacked human beings or animals without provocation, then the court shall have the authority to order the dog kept muzzled, confined, destroyed or delivered to the animal shelter for further action, as provided in Chapter 13 of this code of ordinances.
   2.   The Animal Control Officer, his or her designated representative or any law enforcement officer of the city may kill any dog running loose within the corporate limits of the city which is determined by the Animal Control Officer or law enforcement officer to be vicious or crazed and a threat to the public health and safety.
