§ 16-60 COLLECTION AND DISPOSAL DECLARED TO BE A MUNICIPAL FUNCTION.
   1.   The collection and disposal of garbage, trash and refuse and other solid waste is hereby declared to be a municipal function of the city. The use of the city’s solid waste collection and disposal system is required of all houses, buildings or property used for human occupancy with the city limits. As a protection of the public health, the police powers of said city shall be invoked when necessary for the enforcement of this chapter. In addition the city may collect and dispose of refuse, as it deems necessary; provided, that such disposal shall be an approved method of incineration (not open burning) or by landfill and daily cover.
   2.   Only those persons that are regular customers of the solid waste system for the city shall utilize the refuse collection services provided. It shall be unlawful and offense for any person not an authorized customer of the solid waste to deposit, cause to be deposited or assist in depositing refuse, trash or solid waste in the containers of an authorized customer for its disposal by the solid waste system. Any person violating this subsection 2. shall be subject to the maximum fine that may be imposed by the city.
   3.   It shall be unlawful and an offense for any person, except under contract as hereinafter provided for, to remove or cause to be removed any solid waste materials from any garbage can or receptacle used for the deposit of same, or to transport or haul, carry or otherwise move over any of the streets, alleys or other public ways any solid waste material.
