§ 5-107 CIRCUS AND CARNIVAL.
   1.   No person shall erect, operate or exhibit any circus or carnival within the city in any structure composed wholly or partly of canvas, or any similar material, unless the person has complied with all the requirements of this article.
   2.   No person shall operate a circus within the city without first obtaining a permit as required by this article.
      a.   Application for permit. An application for a permit to operate a circus or carnival shall contain the following information:
         (1)   Name and business address of the owner;
         (2)   Listing and locations of all the games and rides;
         (3)   The proposed dates and times of the exhibition or performances; and
         (4)   The proposed location of the circus.
      b.   Liability insurance. No permit to operate or exhibit any circus or carnival within the city shall be issued until the applicant shall have filed with the city a copy of a public liability insurance policy. The minimum limits of coverage shall be not less than $1,000,000.
      c.   Permit. There is hereby levied a permit fee for the operation and exhibition of a circus or a carnival within the city. The amount of the fees as set forth shall be $250.
      d.   Non-profit organization. There shall be no requirement for the payment of the fee set forth in subsection 2.c. above if the City Council determines that the circus and/or carnival to be held within the city limits is being sponsored by a non-profit organization.
