§ 5-67 TERMINATION OF FACILITIES AS NONCONFORMING USES.
   1.   A day care center located within the R-l or R-2 Zoning District on September 4, 1973 may be maintained and repaired, except as otherwise provided for in this section.
   2.   A nonconforming day care center may not be enlarged or expanded in any manner to increase its nonconforming either in area or use.
   3.   A nonconforming day care center will be terminated immediately if the permit holder or ownership of the property or facility changes.
   4.   A family day care home may continue in operation under the amended definition of day care home as a nonconforming use until August 11, 1984; provided that the day care home was properly licensed by the city for eight children between March 8, 1988, and that the applicant can document that the facility was licensed with the Department of Human Services, Division of Children and Youth Services, as a day care center for eight children or less, or that the day care home application was properly submitted to the city for eight children prior to August 11, 1988; and further provided that if the permit holder or ownership of the property or facility changes, then the current definition of a family day care home will apply.
