§ 5-10 SPECIFIC REGULATIONS FOR MOBILE FOOD-SERVICE ESTABLISHMENTS; SALES ONLY.
   1.   Mobile food-service establishments-sales only are allowed when all occupants of the establishment possess a current and valid city-issued identification badge and permit. The city-issued identification badge shall be worn or attached to the occupant’s outside clothing and be visible to all customers during hours of operation.
      a.   Application for city-issued identification badge shall be made through the city’s licensing agent upon forms provided by the city.
      b.   All applications for an identification badge shall be immediately referred to the Police Department for background investigation as to the truth thereof, which investigation shall be conducted as provided in this article.
      c.   The Police Department shall deny the application if the investigation shows that the applicant:
         (1)   Has been convicted within three years immediately preceding the date of the application, of any felony or misdemeanor offenses when the Police Department determines that such conviction will reasonably and directly indicate a potential risk to the public safety;
         (2)   Has, within one year immediately preceding the date of the application, made misrepresentation of material facts on the application, made alteration of any kind on a previously city-issued license or permitted another person to use such license or permit; or
         (3)   Upon a finding that the applicant has been dealing in defective goods.
      d.   If the application has been denied, the applicant will be advised of the denial and that an appeal of a denied application may be submitted to the City Council by delivering a written appeal to the City Clerk within 15 calendar days from the date of the denial.
      e.    If the application is approved, a city-issued identification badge shall be issued after payment of the fees as provided in the fee schedule and the presentation of two recent personal passport type photographs.
   2.   Occupants within said establishment shall not be required a food handler’s certification.
   3.   Establishments may be allowed to stop upon streets classified as local streets, as defined by the subdivision regulations or the long range transportation plan, to conduct sales and only if said street has a posted speed limit of 25 mph or less, but in no case shall establishment block any traffic or create a hazardous condition.
