1. Mobile food-service establishments shall only operate out of vehicles that have been approved and licensed by the Health Department.
2. Mobile food-service establishments shall not be located at a single location or address for more than 12 hours in a 24-hour period. A single location or address shall include a single parking lot shared by multiple businesses or tenants. At the end of the 12-hour period the mobile food-service establishment shall be removed.
3. Permission from the nearest business must be obtained by the mobile food-service establishment for use of restroom facilities. The restroom facilities shall be conveniently located and accessible to employees during all hours of operation.
4. Mobile food-service establishments that are invited to participate in a city permitted event, fair, carnival, circus, public exhibition or similar transitory gathering shall be allowed to operate during all hours in which the event is open to the public and shall be allowed to remain at such location during the duration of the event.
5. Mobile food-service establishments shall obtain permission before operation on any property from the owner of said property.
6. Unless part of a city permitted event as described above, a mobile food-service establishment may obtain a city property operation permit to operate on a city owned property such as parks, provided that they meet all of the following guidelines:
a. Application must be received at least two business days prior to setting up at the proposed location;
b. All applications must be approved by the Community Services Director and the Parks and Recreation Director or their respective designees;
c. Use of delineated parking areas shall be avoided;
d. If the application is approved, the mobile food-service establishment shall pay a fee provided for in the fee schedule. The time frame of the temporary permit will be for up to three consecutive days;
e. The mobile food-service establishment permitted to operate on the city park property shall only operate during the park hours of 6:00 a.m. to 11:00 p.m., or as posted at each park;
f. A city property operation permit shall not allow the setup and operation on public right-of-way or easement;
g. The area used by the mobile food-service establishments shall have all trash and appurtenances removed at the end each day or when the mobile food-service establishment leaves the location, whichever comes first; and
h. Failure to comply with this code could result in the City Clerk revoking the right to be issued a city property operation permit for a period up to 12 months.
