For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ALL TERRAIN VEHICLE (ATV).
(1) A motorized vehicle with:
(a) Not less than three, but not more than six low pressure or non-pneumatic tires;
(b) A total dry weight of 2,000 pounds or less; and
(c) A total width from outside of tire rim to outside of tire rim that is 65 inches or less.
(2) ALL TERRAIN VEHICLE includes a Class 1 all terrain vehicle and Class 2 all terrain vehicle. ALL TERRAIN VEHICLE does not include a golf cart, mini-truck, dune buggy, or go-cart or a vehicle designed and used specifically for lawn maintenance, agriculture, logging, or mining purposes.
INSURANCE. Motor vehicle insurance which complies with the requirements set forth in M.S. § 65B.48, subd. 5, as it may be amended from time to time.
MOTORIZED GOLF CART. A vehicle, usually three or four wheeled, which is self propelled and designed to normally provide transportation on a golf course.
PHYSICALLY DISABLED PERSON. Any person meeting the criteria set forth in M.S. § 169.345, subd. 2, as it may be amended from time to time, that qualifies for a certificate allowing the person to park in a handicapped parking space.
SLOW MOVING VEHICLE EMBLEM. A sign which complies with the requirements set forth in M.S. § 169.522, as it may be amended from time to time.

Any person desiring a permit to register an all terrain vehicle or motorized golf cart shall submit an application to City Hall along with a fee established by the City Council, which should include the following information:
(A) Application date;
(B) Applicant's name and address;
(C) Copy of applicant's valid driver's license;
(D) Proof of insurance company and policy number for operation of the all terrain vehicle or motorized golf cart;
(E) If the applicant does not possess a valid driver's license, the applicant must submit a certificate signed by a licensed physician that the applicant is able to operate an all terrain vehicle or motorized golf cart; and
(F) Applicants must have proof of DNR registration for all terrain vehicles.

(A) All terrain vehicles or motorized golf carts are allowed to operate on city streets if the owner obtains a permit under this chapter.
(B) All terrain vehicles or motorized golf carts may make a direct crossing of a city street without obtaining a permit or displaying a slow moving vehicle emblem.
(C) All terrain vehicles are not required to obtain a permit if they are being utilized to clear snow from sidewalks and/or driveways from the operators property or from a neighbor’s within 350 feet of operators property.
(D) All terrain vehicles are not required to obtain a permit if they are being utilized to drag a ball field.
(E) Operators must be at least 16 years of age and have a valid driver's license. All driver's license provisions and restrictions apply.
(F) The permit shall be affixed to the uppermost portion of the left (operator's) side of the all terrain vehicle or motorized golf cart.
(G) No person shall operate an all terrain vehicle or motorized golf cart in inclement weather or when visibility is impaired.
(H) Motorized golf carts shall display the slow moving vehicle emblem provided for in M.S. § 169.522, as it may be amended from time to time.
(I) Operators of all terrain vehicles or motorized golf carts shall obey all traffic laws when traveling on city streets. All terrain vehicles or golf carts shall operate on the far right hand side of the road or shoulder.
(J) No towing of people is allowed.
(K) Permitted all terrain vehicles or motorized golf carts may only carry the number of passengers for which the vehicle is designed.
(L) All terrain vehicles or motorized golf carts must be operated on the extreme right hand side of the roadway and no faster than 20 mph.
(M) No person operating a motorized golf cart or ATV under this ordinance shall cross Highway 14 or drive along 2nd Avenue NW or 7th Street NW and 7th Street NE, those portions of 7th Street that are considered to be a County Road.
(N) A person operating a motorized golf cart or all terrain vehicle under this section shall not cross Highway 14 or drive along 2nd Avenue NW.
(O) All terrain vehicles or motorized golf carts are not permitted on Byron's walking/bike trail system and/or sidewalks.
(P) All other rules and regulations governing operation of all terrain vehicles apply per M.S. § 84.92.
