(A) (1) The Michigan Motor Vehicle Code, 1949 PA 300, M.C.L.A. §§ 257.1 et seq., as amended, together with all subsequent amendments thereto, is hereby adopted by reference for the City of Burton.
(2) Pursuant to the authority granted with the adoption of 2012 PA 7, the City of Burton specifically adopts Section 625(1)(c) of the Michigan Vehicle Code by reference.
(B) References in the Michigan Motor Vehicle Code to “local authorities” shall mean the City of Burton.
(C) (1) The penalties as provided by the Michigan Motor Vehicle Code are adopted by reference, provided however, that the penalty, except as provided in sub-paragraph (C)(2) below, shall not exceed a period of incarceration in excess of 93 days.
(2) Pursuant to the authority granted with the adoption of 2012 PA 7, a violation of Section 625(1)(c) of the Motor Vehicle Code as adopted above shall be punishable by 1 or more of the following:
(a) Community service for not more than 360 hours.
(b) Imprisonment for not more than 180 days.
(c) A fine of not less than $200 or more than $700.
(D) A violation of the Michigan Motor Vehicle Code shall be numbered 58-9, followed by the section citation of the Michigan Motor Vehicle Code, or, alternatively a violation may be numbered 70.01 followed by the section citation of the Michigan Motor Vehicle Code. The designation of 58-9 or 70.01 preceding the code section citation shall indicate that the violation is being prosecuted pursuant to city ordinance, not state law.
