5-2-14: PROCEDURES AND PENALTIES OF IDAHO INFRACTION RULES:
   A.   Failure To Pay; Issuance Of Infraction Citation Or Complaint: Upon the failure of any owner or operator charged with a violation of this chapter to pay the required fine by following the administrative procedures provided for in section 5-2-13 of this chapter within ten (10) days after said parking violation, or who pleads not guilty to said parking violation within seven (7) days as prescribed in section 5-2-13 of this chapter, the chief of police or enforcement officer may, after giving written notice of intent to cite the parking violation(s) as infractions, file an infraction citation or complaint with the magistrate division of the district court against the owner or operator of the vehicle cited for the violation of this chapter, said infraction may be prosecuted by the city prosecuting attorney. Written notice to the owner or operator is deemed sufficient if mailed, with proper postage, to the last known address of such person. The infraction may be signed five (5) days after the date such notice is mailed.
   B.   Administrative Procedures And Penalties No Longer Apply: Once an infraction citation or complaint is issued, the administrative procedures and penalties set forth in section 5-2-13 of this chapter shall no longer apply to the alleged violation.
   C.   Idaho Infraction Rules Apply: Once an infraction citation or complaint has been issued, the procedures and penalties set forth in the Idaho infractions rules shall apply to the violation and shall be followed. The Idaho infraction rules are hereby adopted by the city by reference as they now exist or may hereafter be amended. (1974 Code § 7-214)
