a. Organization
There shall be a Board or Zoning Appeals composed of five (5) members not holding any other incompatible public or private office or appointment, to serve for a term of three (3) years.
b. Powers and Duties
The Board shall have powers to hear and determine appeals from refusal of Building and Zoning Permits and to permit exceptions to and variations from the Zoning Regulations in individual cases as may be required to afford justice and avoid unreasonable hardship to property owners in accordance with standards established by ordinance of Council and such other powers as are now or may hereafter be conferred upon it by the laws of Ohio or by ordinance of Council.
c. Appeals
All appeals shall be filed with the Board of Zoning Appeals within twenty (20) days following any action taken by the Building and/or Zoning Inspector, and/or the Planning Commission and shall be upon the form provided and the necessary fee shall be paid in advance.
d. Public Notice
1. At least ten (10) days before the hearing on any appeal(s), public notice, including the time and place of the hearing, shall be given in a newspaper of general circulation within the City; and
2. At least ten (10) days before consideration of a variance request, written notice, by First Class U.S. Mail with a Certificate of Mailing, shall be given to the property owners residing within the corporation limits of the Municipality within:
A. 200 feet from such parcel or parcels for which an area variance is requested; or
B. 500 feet from such parcel or parcels for which a use variance is requested;
C. The manner in determining the addresses of the property owners shall be the same as outlined in Section 6.02c.3.
D. The calculation of the 200 feet and 500 feet in Section 6.04d.2.A. and B. shall not include the width of any public right of way such as, but not limited to, any avenue, street, roadway, highway or interstate.

e. Review
Upon motion of any two (2) members of the Board, any rule, regulation or decision of the Board, may be reviewed. No such review shall prejudice the rights of any person who in good faith has acted on any decision of the Board prior to the review.
