§ 51.027 REPORTING OF PLANNED CHANGES IN FACILITY CONDITIONS.
   (A)   Each industrial user, whether or not the user has been required to obtain a wastewater discharge permit, must notify the Superintendent of any planned changes to the user’s operations or system which might significantly alter the nature, quality, or volume of its wastewater at least 90 days before the change.
   (B)   The Superintendent may require the user to submit any information as may be deemed necessary to evaluate the changed condition, including the submission of a wastewater discharge permit application under § 51.046.
   (C)   The Superintendent may issue a wastewater discharge permit under § 51.048, or modify an existing wastewater discharge permit under § 51.051 in response to the changed conditions that are anticipated by the user.
   (D)   Planned, significant changes which are subject to this section include, but are not limited to:
      (1)   Expansion or addition of wastewater generating production lines or processes;
      (2)   Projected increases of 20% or greater in monthly flow over the previous year’s highest monthly flow, or annual average flow over the previous year’s annual average flow; and/or
      (3)   The discharge of any previously unreported pollutants.
