(A) No unauthorized person shall uncover, make any connections with or opening into, alter, or disturb any public sewer or appurtenance thereof without first obtaining a written permit from the Wastewater Utility Superintendent or the Superintendent's designee. Permits concerning building sewer connections, which form is approved by the Wastewater Utility Superintendent, shall be first submitted to the Clerk-Treasurer of the town who shall collect a $35 fee at the time of the application submission.
(B) (1) There shall be two general classes of building sewer permits for connection to the sewage works via a public sewer:
(a) A permit for domestic, residential buildings or structures, including two subclasses established in § 51.069; and
(b) A permit for a building or structure other than a domestic building or structure, including all commercial and industrial facilities.
(2) In either case, the owner or his or her agent shall make application on a special form furnished by the town for permission to construct a building sewer and make connection to the town’s public sewers. The permit application shall be supplemented by any plans, specifications, or other information considered pertinent in the judgment of the inspector.
(C) A connection charge for connecting a building sewer to the town’s public sewers, as specified in § 51.069, shall be paid to the Clerk-Treasurer at the time the application is filed.
(D) All costs and expenses incident to the installation and connection of a building sewer shall be borne by the owner. The owner shall indemnify the town from any loss or damage to the town that may directly or indirectly be caused by or result from the installation of the building sewer.
(E) A separate and independent building sewer shall be provided for:
(1) Each single-family dwelling unit and/or EDU;
(2) Each dwelling unit and/or EDU located in a single-story, multi-family dwelling unit; or
(3) Each multi-story, multi-family structure, irrespective of the number of dwelling units or EDUs contained therein.
(F) Old building sewers may be used in connection with new buildings only when they are found, on examination and test by the inspector, to meet all requirements of this chapter.
(G) The size, slope, alignment, and materials of construction of a building sewer, the methods to be used in excavating the pipe trench, in placing, jointing, and testing of the sewer pipe and in backfilling the trench, and the methods and materials to be used in connecting the building sewer to the public sewer shall all conform to the requirements of the Building and Plumbing Code or other applicable rules and regulations of the town. In the absence of code provisions or in amplification thereof, the materials and procedures described in appropriate specifications of the A.S.T.M. and S.P.C.F. Manual of Practice No. FD-9 shall be complied with. All connections of building sewers to the public sewers shall be made gas-tight and water-tight in accordance with these codes, rules and specifications. Any deviation from the prescribed procedures and materials must be approved by the Superintendent before installation.
(H) Whenever possible, the building sewer shall be brought to the building at an elevation below the basement floor. In all buildings in which any building drain is too low to permit gravity flow to the public sewer, sanitary sewage carried by the building drain shall be lifted by an approved means and discharged to the building sewer.
(I) No persons shall make connection of roof downspouts, exterior foundation drains, areaway drains, or other sources of surface run-off or ground water to a building sewer or building drain which in turn is connected, directly or indirectly, to a public sanitary sewer.
(J) The applicant for a building sewer permit shall notify the inspector when the building sewer is ready for inspection and connection to the public sewer. The connection and testing shall be made under the supervision of the inspector or his or her representative. The applicant shall provide access to all structures and areas of structures to the inspector for the purpose of establishing compliance with § 51.004(H).
(K) All excavations for building sewer installation shall be adequately guarded with barricades and lights so as to protect the public from hazard. Streets, sidewalks, parkways, and other public property disturbed in the course of the work shall be restored in a manner satisfactory to the town.
