§ 92.043 FAULTY ALARMS.
   (A)   Whenever a Fire Department dispatches fire apparatus or personnel three (3) or more times in a calendar year to a building or premises in response either to an alarm caused by improper installation or improper maintenance, or if it is not notified that an alarm is a drill or test, a service charge may be imposed as follows:
      (1)   For each piece of fire apparatus other than vehicular, the service charge will be one hundred dollars ($100).
      (2)   For each supervisory vehicle(s), a service charge of fifty dollars ($50).
   (B)   The service charge shall be paid to the Fire Department.
   (C)   Failure to comply with the provisions of this section shall constitute a Class A violation under § 39.05 of this code.
