§ 92.999 PENALTY.
   (A)   Any person who shall violate any of the provisions of this code or standards adopted, or shall fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the authority having jurisdiction or by a court of competent jurisdiction, within the time fixed herein, severally for each and every such violation and noncompliance, respectively, may be fined in an amount of not less than four hundred dollars ($400) and not to exceed two thousand five hundred dollars ($2,500). The imposition of one (1) penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time (not to exceed ten (10) days); and when not otherwise specified, each day that prohibited conditions are maintained shall constitute a separate offense.
   (B)   The application of the penalty in division (A) above shall not be held to prevent the enforced removal of prohibited conditions.

   (C)   In addition to the remedies provided by division (A), any court having jurisdiction may, in addition to or in the alternative, compel compliance with the provision violated or compel correction of the hazardous condition created.

   (D)   Any work commenced on any of the permitted systems prior to a permit being issued will result in a penalty of one thousand dollars ($1,000) per day until such permit is obtained. A "Stop Work" order shall be placed upon the activity for which no permit has been issued in accordance with this section.
