(A) Halloween amusements defined. As used in this section, HALLOWEEN AMUSEMENT shall mean haunted house, house of horrors, or any other activity in which persons are invited, guided, escorted, or otherwise transported through a building or structure or portion of a building or structure, for purposes of entertainment, or amusement, during the month of October.

(B) Permit required.
(1) No person shall operate a Halloween amusement without first obtaining a permit from the appropriate Fire Prevention Bureau.
(2) A Halloween amusement permit shall be issued only after the Bureau has had the opportunity to inspect the amusement and has found it to be in compliance with applicable fire and life safety codes.

(C) Permit application. The application for a Halloween amusement permit shall contain the following information:
(1) The name of the organization sponsoring the amusement.
(2) The names of the persons in charge of the operations of the amusement.
(3) The period of time (date and hours) in which the amusements will be operated.

(D) Inspections. Before a permit may be issued pursuant to this section, an authorized representative of the Bureau shall inspect and certify that the building or structure complies with applicable fire and life safety requirements for its intended occupancy. The inspection shall occur no earlier than September 15 of the year for which the permit is sought.

(E) Issuance of permit. A permit shall be issued only after the Bureau of Fire Prevention has had an opportunity to inspect the subject premises, and has found that the building or structure conforms with all applicable fire and life safety requirements established by this code or by the Indiana Fire Code.

(F) Appeal from denial. Whenever the Bureau shall reject or refuse to grant a permit required by this section, or when it is claimed that provisions of this section or any other provision of this code relating thereto do not apply, the person may appeal from the decision in writing as provided in § 92.105.

(G) Permit period. Each permit granted under the provisions of this section shall be for a period which the Fire Marshal of the Bureau may determine; however, any permit shall expire on November 1 of the year it is issued.

(H) Display of permit required. A permit issued pursuant to this section shall at all times be kept on the premises designated in the permit, and shall at all times be subject to inspection by anyone duly authorized by the Fire or Police Department.

(I) Transferability. A permit issued pursuant to this section shall not be transferable, and any change in use or occupancy of premises shall require a new permit.
