Where the Commissioner determines that the owner of a local brownfield site or its successors or assigns has failed to continue in full force and effect any institutional and engineering controls required at such site in accordance with any applicable document or plan, he shall notify the Building Department of such failure and the Building Department shall withhold and/or remove the permits from such site.
