1728.99 PENALTY.

   (a)   Whosoever violates the provisions of this chapter with respect to residential property shall:

      (1)   For the first offense pay a fine of not more than one hundred dollars ($100.00);

      (2)   For a second offense pay a fine of not more than five hundred dollars ($500.00); and

      (3)   For a third and all subsequent offenses pay a fine of not more than one thousand dollars ($1,000).

   (b)   Whosoever violates the provisions of this chapter with respect to nonresidential property shall:

      (1)   For the first offense pay a fine of not more than two hundred fifty dollars ($250.00);

      (2)   For a second offense pay a fine of not more than six hundred and fifty dollars ($650.00); and

      (3)   For a third and all subsequent offenses pay a fine of not more than one thousand three hundred dollars ($1,300).
