1351.01 PERMIT AND CONSTRUCTION REGULATIONS.
   (a)   Structures and devices for private radio and television reception, other than satellite dish antennas, may be erected on any building without a permit, provided the highest point of such assembly is not more than twelve feet higher than the highest point of the roof, and provided further, that such assembly is not erected closer to the lot line or public space than the height of the antenna assembly.
   (b)   Permits shall be required for all antenna assemblies more than twelve feet high and all satellite dish antennas. Application for permits shall be accompanied by details of the antenna assembly, its proposed location, and method of attachment and anchorage.
   (c)   Wiring and grounding of the antenna shall comply with the applicable provisions of the National Electrical Code, as such provisions now exist or as they may be hereafter amended.
   (d)   Radio and television towers and antennas and satellite dish antennas shall be designed for:
      (1)   Dead load plus 100 percent (100%) to include ice formations; and
      (2)   Wind load requirements of signs and similar structures established by the applicable provisions of the Ohio Basic Building Code, as such provisions now exist or as they may be hereafter amended.
   (e)   Towers, antennas, guys, braces, and anchorage shall be constructed of corrosive-resistant noncombustible materials, except that towers and antennas may be built of timbers when less than 100 feet in height above the ground and located a distance from any building or property line equal to their height or more.
   (f)   Any radio tower which exceeds the following height limitations may not be erected or used unless approval is given by the Building Commissioner and such tower complies with regulations of the Federal Aviation Administration and/or Federal Communications Commission.
      (1)   Any construction or alteration of more than twenty feet in height above ground level at its site.
      (2)   Any construction or alteration of greater height than an imaginary surface extending outward and upward at one of the following slopes.
         A.   100 to 1 for a horizontal distance of 20,000 feet from the nearest point of the nearest runway of each airport with at least one runway more than 3,200 feet in length, excluding heliports and seaplane bases without specified boundaries, if that airport is either listed in the Airport Directory or the Current Airman's Information Manual, or is operated by a Federal Military Agency.
         B.   50 to 1 for a horizontal distance of 10,000 feet from the nearest point of the nearest runway of each airport with its longest runway no more than 3,200 feet in length, excluding heliports and seaplane bases without specified boundaries, if that airport is either listed in the Airport Directory or is operated by a Federal Military Agency.
         C.   25 to 1 for horizontal distance of 5,000 feet from the nearest point of the nearest landing and take off area of each heliport listed in the Airport Directory or operated by a Federal Military Agency.
      (3)   Any construction or alteration on an airport listed in the Airport Directory of the Current Airman's Information Manual.
      A notification to the Federal Aviation Administration is not required for any of the following construction or alteration station antenna structure:
         A.   Any object that would be shielded by existing structures of a permanent and substantial character or by natural terrain or topographic features of equal or greater height, and would be located in the congested area of a city, town or settlement where it is evident beyond all reasonable doubt that the structure so shielded will not adversely affect safety in air navigation. Applicants claiming such exemption shall submit a statement with their application to the Commission explaining the basis in detail for their finding.
         B.   Any antenna structure of twenty feet or less in height except one that would increase the height of another antenna structure.
   (g)   The power output at the transmitter terminals and delivered to the antenna, antenna transmission line or any other impediment matched, radio frequency load, shall not exceed that prescribed in the station license, and/or Federal Communications Commission Regulations, Part 5, paragraph 95.43.
   (h)   In issuing a permit for the construction of any radio tower, the Building Commissoioner shall require that every tower should comply with the applicable provisions of the National Electrical Code, as such provisions now exist or as they may be hereafter amended. Furthermore, the Commissioner shall insure that all radio towers now being used in the City comply with the regulations of the Federal Aviation Administration and Federal Communications Commission.
