1347.01 FENCING INSPECTION; REPAIR NOTICE PROCEDURE.
   (a)   The City, through Council, hereby orders and directs the Building Commissioner to inspect at least once a year all fences and brick walls between residential and non-residential properties within the City. The Commissioner is directed to keep a record of all fence and brick wall inspections to be on file in the office of the Building Commissioner.
   (b)   The Commissioner is hereby authorized and ordered upon finding deteriorated fencing or fencing in the state of disrepair between residential and nonresidential properties, to give a thirty day notice to the owner of such property to repair the fence or brick wall to the specifications required upon issuance of the original building permit. The purpose of such notice is to order the owner to repair the property or show cause why it cannot be done within thirty days.
   (c)   Any person in violation of subsection (b) hereof shall be guilty of a misdemeanor of the fourth degree, and shall be fined not more than two hundred fifty dollars ($250.00), or imprisoned not more than thirty days or both.
