(a) The owner of any premises, building or structure or part thereof where anything in violation of this chapter shall exist or be placed and any person who shall violate any of the provisions of this chapter or be employed to assist in such violation, and all persons who shall fail to comply therewith or with any regulation thereof, shall, for each and every such violation or noncompliance, be imprisoned for a definite term or fined, or both, which terms of imprisonment and fine shall be fixed by the court as provided in this section.
(b) For a first offense the violator is guilty of a misdemeanor of the second degree.
(c) For a second or subsequent offense within one year after the first offense, the violator is guilty of a misdemeanor of the first degree.
(d) Terms of imprisonment for misdemeanors shall be imposed as follows:
(1) For a misdemeanor of the first degree, not more than six months.
(2) For a misdemeanor of the second degree, not more than ninety days.
(e) Fines for misdemeanors shall be imposed as follows:
(1) For a misdemeanor of the first degree, not more than one thousand dollars ($1000) .
(2) For a misdemeanor of the second degree, not more than seven hundred fifty dollars ($750. 00).
