1107.01 DECLARATION OF PUBLIC POLICY AND PURPOSE.
   (a)   The purpose of this chapter is to create the Development Area Design Review Committee (DRC), which shall be made up of representatives of the City of Brook Park and is charged with the responsibility of reviewing all proposed development projects within the U-6 Use District for the purpose of ensuring compliance with the Design Guidelines and fostering high quality development within the City of Brook Park. The DRC shall forward a non-binding written opinion to the Planning Commission as to a development project's compliance or non-compliance with the Design Guidelines.
   (b)   The DRC is also charged with the responsibility of reviewing all proposed variances from the City Building Code for new development with the U-6 Use District and forwarding a non-binding written opinion to the Board of Zoning and Building Appeals regarding each requested variance.
   (c)   The DRC shall be a public body subject to all public meeting requirements prescribed by Ohio R.C. 121.22 or any amendment thereto. The DRC shall maintain public records in the manner prescribed by Ohio R.C. 149.43 or any amendment thereto.

1107.02 COMPOSITION.
   (a)   The DRC shall be comprised of five members. One of the members shall be a Councilperson appointed by the President of Council of the City of Brook Park according to Council Rules. Two public members, residents of the City of Brook Park, shall be appointed by the Brook Park City Council according to Council Rules. Two professional members shall be appointed by the Mayor of the City of Brook Park. The term of the four non-Council members of the DRC shall be five years each. The term of the Council member shall be two years.
   (b)   No member may serve for more than two consecutive full five-year terms.
   (c)   One of the professional members of the DRC shall have a professional degree, license or certification in a field related to architecture or shall have a minimum of five years of experience in a field related to architecture.
   (d)   One of the professional members of the DRC shall have a professional degree, license or certification in a field related to landscape architecture or design, or shall have a minimum of five years of experience in a field related to landscape architecture or design.

1107.03 PROCEDURES.
   (a)   The DRC shall provide a copy of the Development Guidelines to all prospective applicants seeking to build a new structure or substantially renovate an existing structure within the U-6 Use District and to any person requesting a copy of the Development Guidelines.
   (b)   The DRC shall hold meetings at least once a year and as often as required to: (1) review applications from developers and to prepare a written opinion to be forwarded to the Planning Commission on compliance with Development Guidelines; and (2) review requests for variances and to prepare a written opinion to be forwarded to the Board of Zoning and Building Appeals.
   (c)   The DRC shall hold its meetings in City Council Chambers.
   (d)   At the first regular meeting of the DRC the members shall elect from among themselves a Chairman who shall preside at all meetings. The Chairman shall retain all the rights of a voting member. The DRC shall select a vice-chair to act in the absence of the Chairman.
   (e)   A quorum of four members of the DRC is necessary for a meeting to occur.
   (f)   Written opinions or other official actions of the DRC shall require the approval of three members.
   (g)   The DRC shall notify parties directly of any meeting at which the DRC intends to discuss matters concerning the party's development project. Written notice shall be provided no less than seven days before the meeting is scheduled to occur. The DRC shall provide notice of the meeting to the public in the manner commonly used for public meetings in the City.
   (h)   Minutes of the meeting shall be kept by the Secretary of the DRC. The Secretary of the Planning Commission shall also serve as the Secretary of the DRC. All public documents shall be open to inspection to the public at the office of the Planning Commission. The Secretary of the DRC shall prepare the agenda for the DRC and also provide written notice of the meetings at the direction of the Chairman of the DRC. The Secretary shall prepare in writing the opinion of the DRC.
   (i)   An applicant or his or her or its legal representative shall be required to attend all meetings where such applicant's application is being considered. The DRC may invite additional individuals to attend meetings.

1107.04 FUNCTIONS.
   (a)   All applicants seeking to build a new structure or substantially renovate an existing structure within the U-6 Use District shall follow the procedures outlined in the Development Guidelines and this section. Compliance with this section shall satisfy the procedural requirements of the Design Guidelines. In the event of any conflict between the Design Guidelines and this section, this section shall be construed as controlling.
   (b)   The applicant shall not initiate procedures to obtain building, zoning, or other approvals from the Planning Commission or the Building Commissioner until it has obtained the DRC's non-binding written opinion as to the schematic design approval.
   (c)   The Planning Commission shall not approve an applicant's plans and specifications until such time as the Planning Commission receives a non-binding written opinion as to compliance with the Development Guidelines from the DRC.
   (d)   Before the Board of Zoning and Building Appeals renders a decision on any matter before the Board concerning the application of the Building Code of the City to a new development project within the U-6 Use District, the Board shall obtain the non-binding written opinion of the DRC regarding the matter.
   (e)   The written opinions of the DRC shall in no way relieve the applicant of the obligation to follow all applicable City of Brook Park regulations, including the obligation to obtain all necessary permits and licenses.

1107.05 COMPENSATION.
   Compensation for the four non-Council members shall be at the rate of one hundred dollars ($100.00) per meeting, not to exceed one hundred dollars ($100.00) per month.
