(a) Facility Sponsor is City Entity. If the facility sponsor is a governmental official, board, commission, or body of the City of Brook Park, the disapproval of the Commission rendered in accordance with Section 1104.05(c) may be overruled by a vote of not less than two-thirds of the entire membership of Council, with the concurrence of the head of the facility sponsor in any instance where the Council is not also the facility sponsor.
(b) Facility Sponsor is State or Political Subdivision. If the facility sponsor is a governmental official, board, commission, or body of either the State or a political subdivision, the disapproval of the Commission rendered in accordance with Section 1104.05(c) may be overruled by a vote of not less than two-thirds of the entire membership of such official, board, commission or body.
(c) Facility Sponsor is PUC. If the facility sponsor is the Public Utilities Commission of Ohio, the disapproval of the Commission rendered in accordance with Section 1104.05(c) may be overruled by the Public Utilities Commission of Ohio in accordance with State law.
(d) Other Facility Sponsors. If the facility sponsor is either a governmental official, board, commission or body of a municipal corporation other than the City of Brook Park, or otherwise not specified in subsections (a), (b) or (c) hereof, the disapproval of the Commission rendered in accordance with Section 1104.05(c) may be overruled only by a vote of not less than two-thirds of the entire membership of Council, with the concurrence of the head of the facility sponsor.
